How Can NTEU Help?
Union Offers Strong Representation Assistance

Since NTEU chartered its first TSA chapter last year, the union has represented several TSA employees in numerous actions, including failed recertifications, AWOL, and EEO complaints. Here are just a few examples:

• A long-time TSO’s proposed removal for numerous AWOL charges was reduced to a 7-day suspension and ultimately rescinded altogether with the employee receiving back pay because, as NTEU pointed out, the employee had a good work record and TSA lost much of the employee’s leave requests and supporting documentation.

• A 5-year TSO’s removal for AWOL was rescinded after NTEU presented convincing evidence of the employee’s good record, the employee’s unusual personal difficulties surrounding the absences, and the fact that the absences qualified for leave under the Family Medical Leave Act.

• A 4-year TSO’s removal for allegedly lying on her employment application was rescinded when NTEU demonstrated that her application statements were truthful.

• A proposed removal of a dual-certified TSO for failing recertification was rescinded after NTEU presented employee’s good record, deficiencies in TSA training and information on disparate treatment.

• A TSO who allegedly verbally abused a supervisor saw a three-day suspension reduced after NTEU took the case before a peer review panel and proved that the supervisor instigated the confrontation. The employee also was awarded two days of back pay.

NTEU attorneys and labor relations experts have personally represented TSOs in all these cases. Our goal is to secure TSOs nationwide full collective bargaining rights, while providing professional job-site representation that ensures fair and equitable treatment.

Just because you do not have collective bargaining rights, it does not mean NTEU cannot represent you in a meaningful way.

We will:

• File grievances over disputed AWS, disciplinary actions, work schedules and performance appraisals;

• Represent you before the TSA Disciplinary Review Board;

• Represent you before the TSA Inspector General Office;

• Make your voice heard in Congress, the media, and the courts.

Remember, the law requires that TSA employees be able to join unions
and engage in union activities without fear of retaliation or discrimination.
